Tip Credit Rules (Federal)
Federal minimum wage: $7.25/hour. Federal tipped minimum wage: $2.13/hour. The difference ($5.12) is the "tip credit" — the employer credits the employee's tips toward meeting minimum wage. If tips + $2.13 don't add up to $7.25/hour, the employer must make up the difference. IMPORTANT: Many states have higher minimums and different tip credit rules. 7 states have NO tip credit at all (CA, OR, WA, NV, MN, MT, AK) — you must pay full state minimum wage plus tips.

IRS Reporting Requirements
- 1Employees must report all cash tips of $20+ per month to the employer (IRS Form 4070)
- 2Employer must withhold income tax, Social Security, and Medicare on reported tips
- 3Credit card tips are automatically tracked — employer reports them on W-2
- 4Employers must file Form 8027 annually if they have 10+ employees and tip at least $20 per typical day
- 5Allocated tips: if total reported tips are less than 8% of gross receipts, employer must allocate the difference
